Garage apartments in Charlotte

Keep the parking, add a home above it. In Charlotte the key limits are the height of your main house and the setbacks that apply to taller accessory buildings.

Detached garage

Can I build an apartment over a garage in Charlotte?

Yes, as long as it follows the city's ADU rules, as of October 2026. The ADU can sit in a detached accessory structure, can use up to 50% of the main home's floor area, and cannot be taller than the main home. On a lot with a one-story house, that height rule is often what decides the design.

How does the height rule play out?

A garage apartment is a two-level building. If your house is a single-story ranch, the new building cannot rise above it, which usually means a low-slope roof, a lower garage ceiling or a design that tucks the upper floor into the roof. Two-story houses give far more room. We measure your house's height at the site visit before we sketch.

What setbacks apply to a taller garage?

Charlotte's rules require accessory structures that are 24 feet or taller, or taller than the main house, to sit at least 15 feet from the rear lot line and meet the district's side setback. Because an ADU cannot exceed the main house's height, the 24-foot trigger is the one most garage apartments run into on lots with taller homes.

Does the garage count toward the size limit?

The 50% cap applies to the ADU. Separately, all accessory structures on the lot together cannot exceed the heated first-floor area of the main house. A large garage plus an apartment can hit that second limit first, so we run both numbers.

What makes it different to build?

  • Structure. Footings and framing sized to carry a living floor.
  • Stairs. A code-compliant stair inside or out, which takes floor or yard space.
  • Fire separation. A rated floor-ceiling between parking and living space.
  • Plumbing. Supply and drain lines carried to the upper floor.
  • Driveway. The apartment shares the main driveway unless you are on a corner or alley lot.

Garage apartment or cottage?

It depends on whether you need the parking. A garage apartment uses less yard and keeps covered parking, but costs more per square foot because of the stair and the heavier structure. A backyard cottage is simpler to build when the yard has room.
