What is a backyard cottage?

A backyard cottage is a detached ADU: a complete dwelling in its own building on the same lot as your house. In Charlotte, as of October 2026, it can be up to half the floor area of the main home and no taller than the main home, and it has to share your existing driveway in most cases.

How big can a cottage be in Charlotte?

The city's permit form caps an ADU in an accessory structure at 50% of the total floor area of the principal dwelling. A 1,600 sq ft house supports a cottage of up to 800 sq ft; a 1,200 sq ft house, up to 600 sq ft. The city's Queen City ADU Program announcement also describes detached units as capped at about 1,000 sq ft. A 2026 state law, effective January 15, 2027, bars cities of Charlotte's size from capping ADUs below 800 sq ft, which could change the math for smaller houses. See the new state law.

How tall can it be, and how close to the property line?

  • The ADU cannot be taller than the main house.
  • An ADU in an accessory structure may sit in the established rear or side yard, but no closer to the rear or side lot line than the district's required side setback.
  • Accessory structures 24 feet or taller, or taller than the main house, need at least a 15-foot rear setback.
  • HVAC units, eaves and steps may project into required side and rear setbacks by up to half their depth.

Can the cottage have its own driveway?

Usually not. The city's rules say the ADU may not be served by a driveway separate from the main home's. The exception is a cottage on a corner lot or a lot that backs onto an alley, which can take a driveway from the side street or the alley.

Does Charlotte make owners live on site?

Charlotte's permit form requires the ADU and the main home to be under the same ownership but does not list an owner-occupancy requirement, as of October 2026. Both units can be rented long term. The Queen City ADU Program adds rent and tenant-income limits if you take its financing; see the program guide.

How much does a cottage cost?

A 2026 North Carolina cost guide (costtobuildhouse.com) estimates a mid-range 600 sq ft detached ADU in Charlotte at about $120,000 to $175,000, with basic builds near $90,000 and high-end builds near $265,000. Long sewer runs, a panel upgrade and grading add to it. Details in the cost guide.

Will a cottage fit behind my house?

It depends on three numbers: your house's floor area, your district's side setback, and how much accessory building is already on the lot. A detached garage or shed counts toward the accessory structure total. We add it all up during the lot check.
