ADUs in Huntersville, NC

Huntersville's zoning ordinance spells out where an accessory dwelling can go and how big it can be. The town is also large enough for the 2026 state ADU law to apply.

What are Huntersville's ADU rules?

The Huntersville Zoning Ordinance, as published, allows one accessory dwelling per deeded lot where the main structure is a detached house or townhouse. A detached unit's building can have a first-floor footprint of up to 650 sq ft or 50% of the main home's first floor, whichever is greater. It goes in the rear yard, as of October 2026.

Where on the lot can it go?

  • In the rear yard.
  • No closer than 5 feet to the right-of-way or easement of an abutting mid-block alley.
  • No closer than 15 feet to an abutting rear property line.
  • If the accessory building is taller than the house, it must meet the minimum side yard and sit at least 15 feet from the rear lot line.

Can it have its own driveway?

Only in one case. The ordinance says the unit may not be served by a separate driveway unless it is reached from a rear alley and the main house from the street. Otherwise it shares the main driveway.

Is there any paperwork after it is built?

Yes. The ordinance requires the accessory dwelling to be registered with the Planning Director when the certificate of occupancy is obtained. We handle that step at closeout.

Does the 2026 state law apply in Huntersville?

It appears so. Huntersville had more than 50,000 residents in the 2020 Census and is not a coastal town, which puts it within the Regulatory Reform Act of 2026's ADU section. Starting January 15, 2027, covered cities cannot cap ADUs below 800 sq ft, require minimum parking or special zoning approval, charge higher permit fees, or block long-term rental of the house and ADU to separate households. Huntersville has until July 1, 2027, to update its rules.

Should I wait for the new rules?

It depends on your design. If a unit fits the 650 sq ft footprint rule today, there may be no reason to wait. If you want something larger on a smaller house, the 800 sq ft floor in the state law could help after January 2027. We can sketch both versions.
