What counts as an in-law suite in Charlotte?
If the suite has its own kitchen and bathroom and forms a complete, separate unit, Charlotte treats it as an ADU within the principal dwelling. As of October 2026, the city's permit form caps it at 40% of the home's total floor area and says it may not be internally accessible from the main home.
Why can't there be a door between the suite and the house?
Under the city's form, an ADU inside the house cannot have interior access to the main dwelling. That creates a two-family dwelling for building code purposes, which brings in fire separation and fire-rated construction under the North Carolina Residential Code. If you want a connecting door so a parent can reach you easily, the space is usually permitted as part of the main house instead, without a second full kitchen.
Which setup is right for my family?
- Separate ADU. Own entry, own kitchen, no interior door. Can be rented to someone outside the family later.
- Suite within the house. Bedroom, bath and sitting room with an interior connection, but no second complete unit. Simpler to permit, not rentable as a separate dwelling.
- Attached addition. A new wing joined to the house. We confirm with the city how it is classified and which percentage cap applies.

What does the conversion involve?
- Fire-rated walls and ceiling between the two units.
- A separate exterior entrance, often with a short walkway from the driveway.
- Emergency escape openings in sleeping rooms, especially in basements.
- Plumbing for a kitchen, and an ejector pump if the fixtures sit below the sewer line.
- Separate or zoned heating and cooling.
Can I plan for aging in place?
Yes. A no-step entry, wider doors, a curbless shower and blocking in the bathroom walls for grab bars cost little when planned from the start. We add them on request.
Is 40% enough space?
It depends on your house. On a 2,500 sq ft home, 40% is up to 1,000 sq ft, plenty for a one-bedroom. On a 1,400 sq ft home it is about 560 sq ft, closer to a studio. When the state's 800 sq ft floor takes effect in 2027, that number may change for smaller houses in Charlotte.
